If you see a sign in a jewelry store stating that products from the retail facility cannot be exchanged or returned, simply ignore it. This remark is illegal.

  • in the case where there is no sample on the jewelry confirming the quality of the product. This happens when the product is made from low-quality raw materials and delivered from Turkey or China;
  • in the event that the product does not correspond to the test placed on it. Let's say the pendant turned out to be gilded, not gold;
  • in the case when the stones fell out after several days of using the product;
  • in the event that a Swiss watch stops moving in advance.

Returning jewelry in accordance with federal law

So, federal legislation protects the buyer by allowing the buyer to return a defective product within 14 days from the date of purchase. This fact is prescribed in Art. 25 of the Law “On Protection of Consumer Rights”.

Therefore, if you find a defect on the jewelry, return it back to the retail outlet.

However, you should know that the above applies exclusively to products with obvious signs of defect. As for products of proper quality, it will be impossible to return or exchange such jewelry, since it is included in the list of products that cannot be exchanged or returned.

How to return jewelry whose quality does not meet standards?

To return defective jewelry back to your retail outlet, follow these steps:

  • bring the product back to the store, having with you the purchase receipt, passport and jewelry tag;
  • file a claim with the name of the director demanding a refund of the amount of money paid for the product or exchange it for a quality one;
  • wait 10 days, this is the time allotted for the store to make a decision.

Can jewelry of good quality be returned?

As for legal norms, relying on them, it will be impossible to return high-quality jewelry. However, in practice, such cases occur quite often, through a peaceful resolution of the issue.

For example, when purchasing a ring for his wife, a man agrees in advance that if it does not fit in size, he will exchange it for the right one. As a rule, sellers agree to a meeting.

Or let’s say you are a regular customer of this jewelry store, and you didn’t like the product after trying it on at home. Most likely, the store seller will accommodate you if you want to return or exchange the jewelry.

How long can precious metal products be returned or replaced?

Jewelry is a product for which a warranty period of six months is established by the manufacturer or store. If one has not been established, then the state will establish it and it will be equal to two years from the date of purchase.

Therefore, if you purchase a product and find it defective, return it back to the retail facility within the warranty period. This is provided for by Russian legislation.

The presence of a defect is proven by an independent expert commission, and its cost must be paid from the funds of the retail facility.

Conditions for returning a gold item within 14 days

The main and most important fact In order to return the jewelry back to the jewelry store, it is necessary to find signs of defects in it. In addition, an important fact will be both the saved fiscal document and the tag that was attached to the product.

Availability of two latest conditions significantly simplify the return of products of inadequate quality, since you do not have to prove that the product was purchased in this particular retail outlet.

According to current legislation, jewelry is included in the list of goods that cannot be returned or exchanged. However, there are exceptions to this rule, and they can be used to return the jewelry to the store. In what cases does the buyer receive such a right, and what actions must be taken in order to exercise it?

In what cases can a return be issued?

The Law “On the Protection of Consumer Rights” provides for the possibility of returning a product within 14 days from the date of purchase if it does not suit the color, size, style and other similar characteristics, provided that the item has not been used, and The integrity of the factory tags and labels has not been compromised.

Jewelry and ornaments are not covered by this law because... are included in the list of products that are not subject to exchange or return.

You can return such a product only if it does not meet the quality requirements for it:

  • discrepancy between the information provided by the seller during the sale and the actual characteristics of the product: for example, if during an examination of a gold ring it turns out that it is actually made of a different metal and coated with gold plating;
  • the purchased product began to deteriorate: the clasp broke, a stone fell out, the chain broke, etc., provided that the damage is not a consequence of improper use;
  • A watch made of precious metal has stopped running or shows inaccurate time without being adjustable.

Sometimes sellers accept a low-quality product immediately, but in some cases an independent examination may be required.

How to return low-quality jewelry?

In order to return or exchange jewelry that has defects, you must contact the store that sold it. If the return request is refused, you can return the product and receive the money paid for it as follows:

Make a claim addressed to the director or owner of the store, indicating all the circumstances of the purchase and the reasons why you need to replace or accept the jewelry. The document must be prepared in two copies - one must be given to the store employees, and the second must be kept with you, having previously certified it with the signature of the person who accepted it. It is necessary to indicate on it the date of transfer of the document to the seller’s representative. If they refuse to accept the claim, you must send it by registered mail with acknowledgment of receipt;

If, after the expiration of the time period allotted for fulfilling the requirements specified in the claim, the return has not been made, the buyer has the right to go to court. As evidence of his innocence, he can present the jewelry itself with defects, the opinion of an independent expert on their presence, a copy of the claim and the received notification of its delivery to the recipient.

As a rule, such cases are resolved in favor of the plaintiff, so the owners of jewelry stores try not to bring the case to court, but to resolve it peacefully. To do this, it is enough to make a claim in writing and send it to the seller’s representative. If the claims are justified, a full refund will be made.

Everyone likes jewelry, regardless of age and income. However, sometimes the purchase of jewelry can be overshadowed by its dubious quality or inappropriate size. What to do in this situation? Can jewelry be returned?

Returning jewelry

Surely everyone who has visited a jewelry store has seen a sign on the display window stating that purchased items cannot be returned or exchanged. Those who read it involuntarily have a question: are gold jewelry subject to return? If not, why not? We will answer. No, they cannot be returned or exchanged.

This is not at all the whim of a jewelry salon or jewelry manufacturer. There are good reasons for this, which are approved by the legislative authorities. Yes, the well-known rule “the buyer is always right” has not been canceled. But it is worth considering that such correctness can result in serious losses for the jewelry manufacturer. It is for this reason that not every product can be returned, but only those whose return is provided for at the legislative level.

Therefore, before purchasing jewelry, it is important to know which items can be returned to the salon or manufacturer, and whether silver jewelry can be returned.

What products can be returned

What does the law say? Can gold jewelry be returned? The answer is given by one of the sections of the Law “On Protection of Consumer Rights”. It was adopted on the basis of order of the Russian Committee of Precious Metals No. 146 of October 30, 1996. It clearly defines the concepts of precious metals and stones, and also provides both a list of them and a list of jewelry. Those metals and stones that are not included in the list are not precious.

Well, those that are mentioned in this register are allowed to be returned to the seller only if the product has a defect or is defective.

If the jewelry item does not have external or other defects, and the buyer simply decided to return the item he purchased, then the seller has the legal right to refuse an exchange or refund.

It is worth remembering that only the presence of a defect or some defects in a piece of jewelry gives the right to return it.

Return of good quality products

It has been clarified whether jewelry can be returned and which ones exactly. But what if the precious jewelry was bought as a gift, and the size turned out to be inappropriate? Or the product model was not to the recipient’s taste?

The first thing you should do before paying for your purchase is to agree with the seller about the possibility of exchanging the purchased product. This is not so difficult to do, because most jewelry stores do not want to lose their customers and therefore often make concessions.

This can also be done by any legally savvy person on the basis of the Law “On Protection of Consumer Rights”. According to its tenth article, the seller is obliged to provide his buyer with complete and reliable information about the product, on the basis of which the client can make right choice. But it is worth remembering that this can only be applied if information about the product is incomplete. Therefore, it will be easier to come to an agreement, because there is nothing illegal in this either on the part of the seller or the buyer.

Jewelry, its warranty period

All products sold have their own warranty period, and jewelry made from any precious metal is no exception.

Agree, even a piece of jewelry that is completely high-quality at first glance can have its defects. For example, after a few weeks of wear, the lock on an earring or chain may break. Or a pebble falls out. If this was not the fault of the buyer, then this product can be returned under warranty.

For jewelry, the law establishes a warranty period of six months. Therefore, if during a given period of time a breakdown occurs and is not the fault of the buyer, you can safely contact the seller for compensation or repair.

But can jewelry with an expired warranty be returned? There is no need to worry about this either. For two years after the deadline has expired, the buyer can still contact the seller. But it is worth remembering that in this situation, an examination to determine the causes of product failure will be carried out at the expense of the buyer himself. In this case, the money spent on it will not be reimbursed to the buyer, even if the breakdown occurred due to the fault of the manufacturer.

Can jewelry purchased from a pawnshop be returned?

Unfortunately, not everyone has the opportunity to purchase jewelry in salons. Therefore, purchases of products made of precious metals are often made at a pawnshop.

But this absolutely does not affect the ability to return a low-quality product to the seller. The main thing is to keep the receipt, which will confirm that the purchase was made in this particular place. If the pawnshop refuses to refund the money for a low-quality product, you can safely contact the prosecutor’s office or the local consumer protection department.

How to return it correctly

It has been clarified whether jewelry can be returned. But how can this be done as correctly and legally as possible?

If the purchase was marred by a discovered defect (a broken lock, a dropped stone) or a difference in the amount indicated on the receipt and the tag, then it is worth writing a claim to the director of the jewelry store. It should describe in as much detail as possible the reason for returning the product. It is best to write in two copies, the first is given to the seller, and the second, with the signature and seal of the store, should be kept for yourself. It may come in handy if it comes to litigation.

The seller will be required to respond to the complaint within ten days. It will indicate whether the seller returns the money or exchanges the product. He may also order an examination. It should not last more than twenty days.

Thus, in a maximum of a month the buyer will be able to receive the final result on the submitted claim.

Jewelry is great gift and a good financial investment. However, their selection and purchase should be treated carefully, since the process of returning or exchanging goods, if necessary, can be difficult. How to implement it within the framework of legislation is described in Federal Law 2300-1 “On the protection of consumer rights”.

Can jewelry be exchanged or returned?

The return of gold to the store, as well as other products made from precious metals, is prescribed in Art. 18 Federal Law “On Protection of Consumer Rights”. According to the document, for a client of a jewelry salon who purchased an expensive product at full price and discovered defects in it that were not indicated by the seller, filing a claim will be a legal right. The complaint may include the following items:

  • Requirement to replace the product with a similar product without defects;
  • Replacement with another product taking into account the difference in cost;
  • Reducing the price due to the presence of a defect;
  • Compensation for costs incurred when eliminating the defect yourself;
  • Return of the product with subsequent compensation of the full cost.

If the verdict that the product is defective was confirmed by the expert commission, then the client has the right to return it. It is not possible to return a product if the main complaint is customer dissatisfaction with the size or design of the product.

The article notes that the sale of jewelry products is carried out in accordance with the rules established by the Russian government. The key stages of the sale are shown in chapter number 7 from the Decree of the Government of the Russian Federation № 55 . They are also decorated in Art. 26.2 Federal Law “On Protection of Consumer Rights”.

The rules for the sale of jewelry products that comply with the legitimate process are subject to the conditions described below:

  • Each product has a special mark affixed by state assay inspection inspectorates;
  • The presence of a manufacturer's imprint (required for domestically produced jewelry);
  • Gold and silver items weighing up to 3 g can be sold without hallmark;
  • Sale precious stones the highest category is carried out if the seller has a permit certificate;
  • Before the start of sale, products are subject to inspection to identify defects, verify the presence of samples and intact labels;
  • Products made of precious metals inlaid with precious stones are sold in special packaging;
  • If the buyer requires the goods to be weighed, the seller is obliged to satisfy his request, and the weighing is carried out only in the presence of the client;
  • The cash receipt must contain as much information as possible about the product. Otherwise, a sales receipt with similar contents is issued.

The information indicated on the label of a precious item is as follows:

  1. Product name;
  2. Information regarding the manufacturer;
  3. Type of precious metal;
  4. Vendor code;
  5. Hallmark;
  6. Product weight;
  7. Processing method;
  8. Price.

If the jewelry contains an insert made of a semi-precious or other type of stone, then an indication of this circumstance must also be recorded in the label.

Rules for exchange and return of jewelry

A buyer purchasing expensive jewelry must keep in mind that a legal return is possible only if a manufacturing defect has been detected in the product.

Legal grounds for return or exchange:

  • The declared hallmark does not correspond to the actual composition of the precious metal;
  • Inlay in the form of embedded stones does not adhere to the product and falls out of it;
  • The mechanism of the purchased precious metal watch does not work or functions intermittently. Another motive is that the watch’s bracelet broke;
  • The purchased product has parts that do not work well (poorly fitting links, tight lock or clasp, etc.).

It is important to note that a defect that appeared in a product after purchase, and not as a consequence of a manufacturing defect, in accordance with Art. 476 of the Civil Code is not a basis for a return.

Acceptable deadlines

The law sets out clear time limits within which the return precious jewelry will be done within the law. If a product is found to be defective, it must be returned immediately. Products made from gold and silver can be returned or exchanged within:

  • Two calendar weeks from the date of purchase if visible damage is detected;
  • Six months if a hidden defect is discovered during operation of the product.

The warranty period for products made of precious metals is also established by the seller, if it has not been determined by the manufacturer. While the warranty is valid, the product can be returned. However, due to the factors described above, the terms for returning jewelry are often vague, which should also be taken into account by the buyer at the stage of purchasing the product.

Can they refuse?

Despite all of the above conditions, the buyer may encounter a situation where he is denied a refund or exchange of goods. We are talking about legitimate motives for justifying such a decision on the part of the store staff. Its employees have the right to refuse to return or exchange jewelry if the bearer has violated a number of rules, namely:

  1. I decided to return the piece of jewelry after the expiration of the period possible for this procedure;
  2. The goods have a defect caused to them after the sale transaction has been completed;
  3. Guarantee period for gold or silver product expired.

Any other justification for refusal cannot be considered legitimate. The bearer of the goods, if he has fulfilled all the requirements of this law, must know that other reasons for refusal to return money or exchange goods by the seller will be unfounded. If the conflict moves to another plane, the buyer has every right file a complaint with the consumer protection service. If the situation drags on, he can seek help from the court.
